GDPR in Real Estate and Construction: Key Compliance Duties for Developers and Agents

Real estate, development, agent and construction businesses often process personal data in the course of ordinary operations, including identity documents, contact details, tenancy files, purchaser information, and marketing records.

This means that GDPR compliance is not optional; it forms part of the legal framework governing day-to-day business activity in the sector.

As a general rule, personal data should be collected only where there is a lawful basis to do so, used only for specified purposes, kept securely, and retained only for as long as necessary. In the property sector, these obligations may arise in relation to buyers, tenants, sellers, contractors, and service providers alike.

1. Identify the Lawful Basis

Before collecting any personal data, developers and agents should be clear as to the legal basis relied upon. Depending on the circumstances, this may be contract, legal obligation, or legitimate interest, although consent may still be required in certain cases. A clear internal policy is essential to ensure that data is not processed on an uncertain basis.

2. Keep Records Under Control

Old tenant files, rejected applications, and unnecessary copies of identity documents should not be retained indefinitely. Businesses should ensure that retention periods are defined and that files are reviewed regularly. This is particularly important in a sector where a large volume of personal data may be handled on a routine basis.

3. Maintain Compliant Notices

Where a business operates a website or collects enquiries online, it should maintain an up-to-date privacy policy and cookie notice. The same applies where contact forms, newsletters, or digital marketing tools are used. These notices should accurately reflect how personal data is collected, used, shared, and the legal basis relied upon.

4. Review Third-Party Arrangements

Where CRM systems, cloud platforms, IT providers, or marketing agencies process personal data on behalf of the business, the relevant contractual arrangements should be reviewed. Data processing agreements should be in place where required, and responsibilities should be clearly allocated. This is an important part of overall accountability. If your business uses AI tools to process personal data, you may also need to consider the EU AI Act alongside the GDPR. The applicable obligations will depend on the type of AI system and the way it is used.

5. Train Staff Properly

Employees should understand what information may be requested, who may access it, and when it should be deleted or anonymised. Training is particularly important where staff deal with buyer files, tenant records, or property marketing. A business may have adequate policies on paper, but without proper implementation the risk of non-compliance remains.

6. Apply Sector-Specific Care

Real estate and construction projects often involve multiple parties and complex workflows, which increases the risk of mishandling personal data. Developers and agents should therefore ensure that GDPR considerations are built into their procedures from the outset, rather than addressed only after a problem arises. This is especially relevant where properties, marketing campaigns, or project documentation involve identifiable individuals.
