Buying property in Cyprus can be a good investment, but it is important to check the legal position before you sign anything. A proper review can help you avoid delays, extra costs, and problems after the purchase.
1. Check the Title Deed
You should confirm who owns the property and whether a separate title deed exists. If there is no separate title deed, your lawyer should check why, and whether there is any risk for the buyer.
2. Check for Mortgages or other Burdens
A Land Registry search should be carried out to see whether the property has mortgages, charges, liens, or other restrictions. This is one of the most important checks before you commit to the purchase.
3. Check Planning and Building Permits
If the property is new or under construction, make sure the seller has the correct planning permission and building permits. It is also wise to check whether the property has a certificate of final approval, where relevant.
4. Check Whether Anyone is Living There
If the property is already occupied or rented out, your lawyer should check for leases or tenancy rights. This matters because the buyer may have to respect existing agreements and for properties built before 1999, the provisions of the Rent Control Law may apply.
5. Check the Total Cost
Do not look only at the purchase price. You should also check VAT, transfer fees, legal fees, and any ongoing charges such as communal fees. Once the contract of sale is signed, it may need to be registered with the Land Registry Department. This helps protect the buyer’s rights until the transfer is completed.
